1.1. These General Conditions in force are intended to regulate the terms and conditions by which the provision of the Wineway Online Store Service will be governed. hereinafter referred to as Wineway.

1.2. When browsing this website, the User agrees to be bound by the online sales conditions described below, which are intended solely for online sales.

1.3. Wineway may change freely and without prior notice the Conditions of online sales.

1.4. Wineway maintains this website for the exclusive use of “final consumers”, that is, solely for purchases outside its scope of activity, business or profession.

1.5. Online purchase of beverages is only permitted in countries and other territories where the consumption of alcoholic beverages is legal and for persons who are legally permitted, in their country of residence, to purchase and consume alcoholic beverages.

1.6. The User of this website must abandon it if:

- not accepting the Conditions;

- is not a “final consumer”;

- you are not of legal age to purchase and consume alcoholic beverages in your country and/or other territory where you are located;

- if you are in a country or other territory where use and/or access to this website is not permitted.

Products
2.1. The images that illustrate each product on Wineway may differ from the product subsequently delivered, and these same products are also subject to stock outages.

2.2. Wineway does not sell defective products or products of inferior quality to the standards existing in the market.

2.3. The main features of each product shown on www.wineway.pt can be found on each product page.

2.4. The products offered for sale at www.wineway.pt may not exactly match the actual products in terms of image and colors, due to the Internet browser and monitor used.

Prices
3.1. Under Portuguese law, all prices shown on the Wineway online store include the respective VAT rates in force.

3.2. Shipping fees apply per order.

3.3. The exact price of the shipping fee will depend on the country where your order will be delivered and its weight. For additional information on shipping rates by country, please contact us.

3.4. Shipping can be done free of charge for orders that exceed the minimum amount defined on the website, depending on the country or campaign in question.

3.5. Prices are presented in euros, so you should take into account that there may be price differences, with regard to transport costs depending on the country of delivery of the order.

3.6. The total price specified in the final checkout menu includes taxes and shipping costs.

3.7. Prices fixed at the time of order confirmation. You must pay only the exact amount specified in the order confirmation and you must make individual payments for each order.

3.8. price changes

3.8.1. The prices of the products presented on the website are subject to change. Wineway reserves the right to change prices without prior notice.

3.9. Pricing errors

3.9.1. Some products may have an inaccurate price, which is why Wineway checks prices whenever it processes orders.

3.9.2. Please note that even though the website has been updated with extreme care, it is possible that the price information on the website contains errors, so that the prices shown are merely indicative and do not constitute a contractual proposal.

3.9.3. If the actual price of the product is lower than the advertised price, Wineway will refund the difference.

3.9.4. If the price is higher, Wineway will inform the customer of such situation, by email, and will wait, for a period of 15 calendar days, counting from the date on which the email was sent, for his decision to accept the new price or cancel the order.

3.9.5. Promotions published in the Wineway online store may not be applicable to physical stores.

Orders
4.1. To order at www.wineway.pt it is necessary that the user has an email account and that his browser is configured to accept cookies and pop-ups, in order to allow the enjoyment of all the conditions of navigability of the store online Wineway.

4.2. Fulfillment of all orders placed on the site is subject to availability.

4.5.7. You will receive an order confirmation by email.

4.5.8. Your order is confirmed when you select the "Confirm Payment" (Checkout) button at the end of the purchase process.

4.5.9. You will automatically receive an email message. with your order number and all your order details.

4.5.10. By sending the order form, you are accepting the general conditions of purchase, as well as other existing conditions at www.wineway.pt, through links, including the conditions and general terms of use.

4.5.11. The formalization of the order alone does not constitute a reservation of the products.

4.6. data verification

4.6.1. After receiving the order, Wineway reserves the right to confirm address data, credibility and fraud verification.

4.6.2. Regarding the fraud check Wineway will run partially automated checks on all orders to filter out unusual, suspicious or identified transactions as susceptible to fraud.

4.7. Right not to accept the order or cancel the purchase

4.7.1. We reserve the right not to accept your order, or cancel it even after automatic confirmation.

4.7.2. We also reserve the right to cancel any purchase, even if it has already been accepted by Wineway, namely in the following situations:

- the product is no longer available/in stock (payments will be refunded);

- the billing information is not correct or verifiable;

- the order is flagged by our Security Systems as an incorrect order or an order susceptible to fraud;

- the transfer for payment of the order was not received by us within a period of 5 working days after acceptance of your order;

- if there are indications or information that you may not be of legal age to purchase or consume alcoholic beverages as permitted in your country of residence;

- in the event of an error in setting the price of the product;

- if it is not possible to deliver the order to the place/country indicated for this purpose.

4.7.3. In any of the above situations, Wineway will inform the customer via email.

4.7.4. If an order has been placed and payment has been made for products that are no longer available, Wineway will refund the amount paid for the unavailable items.

Payment
5.1. After confirming the order, an email will be sent to the contact address registered in the order by the customer when formalizing it, with all the details about delivery, billing, payment information, products and values.

5.2. If the customer does not receive the order confirmation email, they are requested to contact Wineway via email: info@wineway.pt so that this notification is sent again to the customer's email address.

5.3. Wineway asks all customers to confirm their details.

5.4. If any of the elements of the order are missing, incomplete, or incorrect, and/or the customer wishes to change any information, as long as the order has not yet been shipped, the customer is requested to contact us via e-mail: info@ wineway.pt as soon as possible so that the requested change can be made internally.

5.5. Changes to the details of orders already shipped will have to be analyzed by the Wineway team so that, together with the customer, a more appropriate solution can be found.

5.6. All orders on Wineway will only be processed after payment is actually received, which must occur within a maximum period of 15 calendar days from the date of the order. After this period, the order will be automatically cancelled.

5.7. You can find the payment methods available on the website. We do not accept any other payment methods other than those mentioned. Please do not attempt to pay by any means other than specified. If you do, we cannot be held responsible for loss of payment or any other damages that may arise.

5.8. If you pay by credit card, we will deduct the amount due from your account as soon as your order is processed.

5.9. In the case of payment by Credit Card, all details (eg card number or expiration date) will be sent via encrypted protocol to the company that provides remote electronic payment services, without third parties having access to the transmitted information.

5.10. If you choose to pay by Multibanco Reference, Wineway will start processing the order after receiving payment. This may take a few hours. Once 3 calendar days have passed after placing the order and if we have not received any payment, it will be cancelled.

5.11. This information will not be used by Wineway except to carry out the necessary procedures for the purchase or return, in the case of return, in accordance with the exercise of the right to refund or for communication, to the competent authorities in case of suspected fraud.

Order Security
6.1. Wineway's online store uses one of the safest security technologies among the encryption platforms available on the market.

6.2. your information The payment method will be encrypted from the moment the data is entered until your transaction is processed, and will not be stored on a public server.

6.3. Although we use encryption software, the security of information and payments transmitted over the Internet or via email cannot be guaranteed.

6.4. Wineway cannot be held responsible for any damage suffered as a result of the use of electronic means of communication including, but not limited to, recurring damages from failures or delays in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for communications or virus transmissions.

Shipping and Delivery
7.0. Except for rare exceptions unrelated to Wineway, all orders completed and paid for by Credit Card, Multibanco Reference, PayPal or MBWAY*, will be shipped on the same day, provided that payment has been made by 12:00 on a business day. Orders paid after this time will be shipped the following business day, with the exception of products that indicate limited stock.

The payment option by bank transfer* will have a confirmation period that can vary between 1 to 3 business days (depending on the country of origin of the transfer). In this payment method, Wineway has no control over the execution period of the banking transaction, which is the responsibility of the Customer's Bank. In these cases, the order will be shipped on the day we receive confirmation of payment from the bank.

*The above mentioned payment methods are not available for all countries.

If we have any questions related to the order (delivery address, payment confirmation, products out of stock, etc.), we will contact the customer through our Customer Support. We will wait for a response for three working days. The order will not be shipped until we get a response to our message. If we do not receive any response within this period of time, we will cancel the order and refund the customer.

7.1. To send orders to the requested address, the shipping option must be chosen - National Shipping (in the case of Mainland Portugal and Islands) and International Shipping (in the case of other countries), provided that it is from a country mentioned in the list of countries available in the Delivery menu.

7.2. In general, after shipment, an order on Wineway takes time to be delivered:

- 72 working hours in mainland Portugal;

- Between 5 and 12 working days in Madeira and Azores Islands;

- About 4 business days in Peninsular Spain;

- About 6 business days in the rest of Europe;

- Approximately 7 business days in the rest of the world.

7.3. The deadlines above are merely indicative and may vary depending on the method of payment, see conditions below, as well as during periods of promotions, sales, Christmas or out of stock.

7.3.1. Wineway cannot be held responsible for delays in the delivery of orders during festive seasons (sales, Carnival, Easter, Christmas, New Year's Eve) and the customer should, as a precaution, send an email to info@wineway.pt to confirm that it will be delivered within the period stipulated on the website, www.wineway.pt.

7.4. The products will be delivered on working days, between 9am and 6pm. This service does not include scheduling or marking options, so the delivery of the order will be carried out without prior contact by the carrier.

7.5. A delivery is considered made or a product is considered delivered with the signature of the delivery receipt at the address indicated by the consumer.

7.6. If the order is confirmed on a business day before 12:00 noon and payment is made by Credit Card or via Paypal, the order will be shipped on the following business day (weekends and holidays are not considered business days).

7.7. Payment by Multibanco reference may take between 5 to 7 days to be received, and only after payment confirmation will the shipment be processed.

7.8. Wineway cannot be held responsible for non-compliance, or delay in meeting delivery deadlines due to a force majeure event, that is, an event, act or omission, beyond its control.

7.9. Wineway is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages.

7.10. Customers are responsible for any seizure of their orders, as well as the payment of customs fees, if any.

7.11. In case of return of the products, Wineway will only refund the amount corresponding to them. In case of doubt, the customer can contact Wineway before ordering.

7.12. Wineway has contracted services with specialized carriers for deliveries in Portugal, Europe and most countries in the world. Every effort is made to meet the shipping and delivery deadlines, however it should be noted that possible delays in deliveries may be unrelated to Wineway, and in these cases it is not possible to guarantee exact delivery times.

7.13. After the orders are dispatched, the information for monitoring the shipment will be available in the account of the customers who have placed the order with registration and a notification is also sent via e-mail with the information of the link for monitoring the shipment to all registered customers and unregistered. If for some reason the customer does not receive the shipment confirmation, he is requested to contact Wineway via e-mail: info@wineway.pt so that all available information on the shipment of the order is sent again.

7.14. After notification of dispatch, customers must follow the status of the shipment through the link provided by Wineway, so that they are aware of the status of evolution until the moment of delivery of the order, since Wineway does not notify each change of status of shipping.

7.15. Partial Deliveries

7.15.1. If the order is for several products and Wineway is unable to send them at once due to the unavailability of any of them, it will send them separately, upon prior notice to the customer to the e-mail indicated by him in the order.

7.16. Inspection upon delivery

7.16.1. All products shipped by Wineway must be checked upon delivery.

7.16.2. If the customer finds that the order is damaged, he must immediately return it to the transport company, duly justify the reason for the return on the carrier's delivery note and immediately notify Wineway via email: info@wineway. en.

7.16.3. Wineway will refund the amounts paid for the order and transport as soon as the warehouse receives and completes the return process.

Non-receipt of order
8.1. In the event of an unsuccessful delivery attempt by the transport company due to absence, a notice will be left in the customer's mailbox with the carrier's instructions.

8.2. If for some reason the customer cannot receive the order or pick it up at the place indicated by the carrier, he must contact Wineway so that, together with this, the most appropriate solution is found.

8.3. Any claim for non-receipt of an order must be made within a maximum period of 30 days from the date of placing the order. After this period, Wineway cannot be held responsible for its loss.

Cancellation
9.1. Under the terms of the legislation in force, Wineway recognizes to all its customers the right to terminate the contracts they have entered into, allowing them to return the products within a period of 14 (fourteen) days.

9.2. Order cancellation before shipment

9.2.1. The customer can cancel the order, as long as it has not yet been shipped.

9.2.2. If the customer places an order and wants to cancel it, he must:

- Check the status of the order through the "My Order" menu located in the upper right corner of the main page of the site.

- If the status of the order mentions “Registered”, there is a possibility that it will be cancelled, so you should contact our Customer Service and ask for its cancellation.

9.2.3. If the cancellation request is successful, the customer will be notified by email of this decision and the cancellation will be processed at no cost to the customer.

9.2.4. If the cancellation request is not possible, the products will be sent to the customer who, if he maintains his intention to cancel the order, must refuse to receive them.

9.2.5. The customer can always proceed with the return according to the conditions and return rules mentioned below.

Returns
1. Return of products due to withdrawal
1.1. If for any reason you are not satisfied with the products, you can return them within 15 calendar days of receipt, provided that
the product is in perfect condition, and where applicable with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice, and provided that this is not shown in any way or by any means adulterated

Return of defective products
2.1. The customer has the right to return the products delivered if they are found to be defective. If this is confirmed by Wineway's specialized team, the product will be exchanged or returned at no cost to the customer.
2.2. Returns can be made within 15 calendar days of receiving the order.
2.3. Wineway is not responsible for deficiencies resulting from incorrect use, negligence, poor storage conditions or causes of force majeure.
2.4. Once the goods have been received at Wineway's premises and after validation of their condition, the value will be refunded according to the payment method made by the customer.
2.5 Wineway will proceed with its cashing or sending the order, in case of exchange, being notified of the status of your order by email/sms.

Conditions applicable to Promotional Codes (discounts)
1. When used in accordance with the established rules, a promotion code entitles the user to benefit from a promotion/discount on the purchase of a specific product or for a set of products, during the period indicated/associated with the promotional code/campaign promotional.
2. Promotional codes can only be used for online purchases made on the website. It is not allowed to sell, exchange or give away a promotional code. The customer carrying the promotional code may not upload or make available a promotional code on any website or other public form of gift, donation, sale or exchange. The use of promotional codes for commercial purposes is not permitted.
3. The promotion code is connected with the Wineway brand It is not allowed to use the promotional code in connection with another brand, company or name. It is also not allowed to use the promotional code in an illegal, abusive or disrespectful way, as well as in any other way that could harm Wineway's reputation.
4. The use of the promotional code is subject to only one use per product and per order. Promotional codes cannot be combined with any other promotions or special offers.
5. Promo codes are not redeemable/exchangeable for cash.
6. Wineway is under no obligation to reissue or refund promotional codes. However, in case Wineway decides to reissue or refund a promotional code, it needs to have access to the initial promotional code. To do this, you must keep a copy of your promotional code, otherwise it cannot be reissued or replaced in case of loss.
7. In cases where Wineway reissues/refunds the promotional code, the discount for that amount can only be applied to a purchase equal to or greater than the purchase in which the discount/promotional code was issued.
8. Without prejudice to any other rights, Wineway may have/has the right to immediately invalidate the promotional code if Wineway has reason to suspect that a promotional code is being used: with violation of the aforementioned assumptions, by usurpation or in other cases where Wineway has reasons to do so.

Responsibility
Wineway will only be liable for damages suffered by the customer in the event that such damages result directly from a breach of contractual obligations arising from the willful or gross negligence of Wineway.

Applicable law
1. The present general conditions and all emerging disputes that are related to these general conditions, including their validity, the use of the site or any purchase on the same must be governed by Portuguese law, namely by Decree-law n.º 24/ 2014, of February 14, with the amendment introduced by Law n.º 47/2014, of 07/28.
2. All purchases made on the Wineway website are subject to Portuguese legislation and any conflict or divergence of interpretation of the General Conditions of Online Sale will be submitted to the competent Portuguese Court.

14.4. Wineway is committed to the privacy and security of each client's personal information. Customers' personal data will only be used by group companies. The information you provide us is only intended to provide you with a service that is more suited to your characteristics and needs.
